Side Yard Use of Easements

The information presented here, while believed to be reasonably accurate, should not be relied upon. This information is provided solely as an aid to Holiday Park Homeowners Association (HPHA) members to help them determine which lots may be affected by HPHA’s SYUE, (Side Yard Use Easement) agreements, and to generally understand the SYUE agreement.

Side Yard Use Easements are a peculiar feature of the lots in HPHA. In the early 1970’s,  when the subdivision was still being built/sold out, it was decided to create a “use-easement” in the backyards of many of the lots in HPHA (for more information please see the Notice of Meeting on September 11, 1973 below). The intent was to create more usable back and side yard space for each lot. In its most typical form, the SYUE is ~8 foot wide strip of land that extends from the front edge of the house itself back to the rear property line, effectively making for a wider side and back yard. The result of this being that a neighbor’s back and side yard extends all the way to the exterior wall of his adjoining neighbor’s house. Typically homeowner “X” gives up the right to this 8′ swath of land (although technically ownership stays with homeowner “X”), on say the north side of his house, but then he gains it back south side of his house from homeowner “Y”. These SYUE are actual formal documents that have been filed in Dallas County Courthouse.
